Airnguru Service Terms of Use


These are legally binding terms and conditions (“Terms”) between Airnguru (“Airnguru”) and the entity you represent (collectively, “you,” “your,” or “User”). These Terms govern your use of Airnguru's data, services, websites, software, and other electronic platforms that we operate and may update from time to time (collectively, the “Platform”).


Background

Airnguru provides pricing intelligence, price execution, and automation solutions for airlines. By using our Platform, Users agree to all terms and conditions and represent that they have the right, authority, and capacity to enter into these Terms. If you do not agree to any of these terms, then you may not use the Platform. Similarly, by using our Platform, Users authorize Airnguru to collect, process, and distribute data on their behalf, either directly or via their agents. In turn, Airnguru will store, analyze, and distribute this data in accordance with these Terms.


Standards

Airnguru collects, processes, and curates various types of content. We adhere to industry standards in data management and processing. By participating in the Platform and using our services, Users agree to comply with these Standards. Our Standards are subject to updates, which will be communicated and made accessible to Users.


Data Use

Users are not required to provide any Data, but if chosen to do so, Airnguru will process and distribute this Data in accordance with applicable instructions. Users acknowledge that Airnguru has a proprietary interest in its data compilations. The Data is for User's authorized reference only and should be used solely for internal management purposes. Users agree not to share, resell, transmit, or transfer any of the Data furnished under this Agreement to third parties for any purpose without written consent.


Airnguru Rights of Data and Publishing Activities

Airnguru reserves the right to adjust, edit, and limit the volume and schedule of Data distribution. By providing Data to Airnguru, Users authorize its distribution through our subscription processes. Airnguru may terminate your access for reasons including non-payment or violation of these Terms.


Pricing

In consideration for the use of the Platform, Users agree to pay fees determined in negotiations, which are associated with the size of the company and the data they work on, as well as the product or products they choose.


Payment

Airnguru will issue a monthly invoice for the use of its services. Specific details regarding payment terms, including late payment consequences, will be outlined in the invoice.


Limited Warranty and Indemnification

Airnguru endeavors to maintain the highest standards in its service delivery but does not guarantee the timeliness, accuracy, or completeness of its Data or services. Users shall indemnify Airnguru against claims arising from their use of the Data or Platform.


Data Protection

Airnguru is in the process of certification for ISO27001 and SOC2, ensuring compliance with relevant data protection standards and regulations.


Advertising and Publicity

During the term of this Agreement, Airnguru may use the User’s name and logo for advertising or publicity purposes, subject to the User’s consent.


General Provisions

  • Choice of Law and Jurisdiction: Governed by the laws of Chile and subject to its jurisdiction.

  • Updates and Concurrence with Future Amendments: Continued use of the Platform will constitute acceptance of any future amendments to these Terms.


Use of Services

  • Authorized Use: Clients must use the services only for lawful purposes and in accordance with these Terms of Use.

  • Account Security: Clients are responsible for maintaining the confidentiality of their account information and are fully responsible for all activities that occur under their account.

  • Prohibited Activities: Clients agree not to use the services to:

    • Engage in any unlawful, fraudulent, or malicious activity.

    • Violate any applicable local, state, national, or international law.

    • Transmit any viruses, malware, or other harmful software.

    • Interfere with or disrupt the integrity or performance of the services.
